Contractor Terms of Service
Last updated: September 14, 2026
These terms are an agreement between your business and Gabelgaugedotcom LLC, doing business as GableGauge. The person accepting represents that they have authority to bind the business. These terms supplement the Terms of Service and incorporate the Lead Purchase and Refund Policy. Our Privacy Policy describes our data practices. These contractor-specific duties apply to business use, not to homeowners acting as consumers.
1. Credentials and readiness to perform
You must provide truthful, current business and contact information and maintain all licenses, registrations, permits, bonds, and insurance required for your services and each jurisdiction where you operate. Carry insurance appropriate to the work, including commercial general liability and legally required workers’ compensation. Obtain required project permits before work begins. You are responsible for verifying local requirements even where a state does not license roofing contractors.
Provide authentic evidence when requested and promptly notify us of expiration, suspension, cancellation, disciplinary action, or any change affecting eligibility. Do not offer or perform work outside your qualifications or coverage. We may suspend access pending verification or remediation. Platform approval is not a warranty of your credentials or work.
2. Your work, personnel, and customers
You operate an independent business. You are responsible for your employees, agents, and subcontractors; their qualifications and supervision; jobsite safety; measurements; pricing; written customer agreements; permits; materials; workmanship; warranties; taxes; payments; and legally required notices and cancellation rights. Do not claim that GableGauge employs you, guarantees your work, or authorizes you to bind it.
3. Homeowner information and communications
Use purchased contact information only for the homeowner’s submitted project. Do not resell, share for unrelated purposes, scrape, or add it to unrelated marketing lists. Observe applicable privacy, security, advertising, calling, texting, email, and do-not-call requirements; obtain any additional consent your outreach requires and honor withdrawals promptly. Access to a lead is not blanket permission for automated or prerecorded marketing. Promptly report unauthorized disclosure or misuse and cooperate in remediation.
4. Responsibility for claims and damages
To the fullest extent permitted by law, your business must defend, indemnify, and hold harmless GableGauge and its officers, employees, and agents from third-party claims and resulting judgments, approved settlements, damages, liabilities, and reasonable attorney fees and defense costs, to the extent caused by your business’s or its personnel’s acts or omissions.
This includes negligent or defective work; injury or property damage; misleading statements; missing or invalid credentials or insurance; unlawful communications; misuse or disclosure of homeowner information; infringement; and breach of these terms or applicable law. If GableGauge is sued because of that conduct, your business is responsible for the covered losses and reasonable defense costs. Your business also remains responsible for direct damages caused to GableGauge by its breach, as recoverable under applicable law, without double recovery.
This obligation does not require you to cover losses attributable to GableGauge’s own negligence, fault, breach, or unlawful conduct, or the conduct of others under its control, and does not extend beyond what applicable anti-indemnity and other mandatory laws allow. Liability is allocated only to the extent of your responsibility. Nothing requires insurance coverage prohibited by law.
5. Handling a claim
We will provide reasonably prompt notice of a covered claim; delay relieves your obligations only to the extent it materially prejudices your defense. You may control the defense with qualified counsel reasonably acceptable to us. We will reasonably cooperate at your expense and may participate with our own counsel at our expense, except where separate counsel is reasonably necessary because of a conflict or your failure to defend. You may not settle without our written consent if the settlement admits fault by us, imposes nonmonetary obligations on us, or fails to fully release us. Consent will not be unreasonably withheld. If you fail to provide a required defense after notice and a reasonable opportunity, we may defend and seek reasonable covered costs.
6. Access, disputes, and continuing obligations
We may restrict or terminate access for inaccurate credentials, unsafe or unlawful conduct, misuse of information, or other material violations. The general Terms’ dispute-resolution provisions, including individual arbitration, exceptions, and the 30-day opt-out, apply. For contractor-specific obligations these terms control a conflict with the general Terms, without reducing mandatory legal protections. Data-use restrictions and responsibility for conduct occurring during participation survive account closure. Material changes apply prospectively with acceptance where required.
